User Agreement

These terms describe your rights and responsibilities when using ArcWealth.

This User Agreement ("Agreement" or "Terms") is a legally binding agreement between you and ArcWealth.

ArcWealth is operated by:

By accessing or using ArcWealth's website, web app, and related services (collectively, the "Services"), you agree to these Terms.

If you do not agree, do not use the Services.


1) Relationship to Privacy Policy and Parental Agreement

Your use of the Services is also governed by:

  • privacy_policy.md (ArcWealth Privacy Policy); and
  • parental_agreement.md (ArcWealth Parental Permission Agreement), where applicable.

By creating an account or continuing to use the Services, you confirm that you have read and understood the Privacy Policy.

If you are a minor and ArcWealth requires parental/guardian authorization under applicable law or policy, use of the Services may be conditional on completion of the parental agreement flow.

1.1 Cookie consent

ArcWealth shows a cookie banner so you can allow necessary cookies before placing authentication-related cookies described in the Privacy Policy. Signing in (including email/password and “Sign in with Google”), two-factor authentication flows, and other features that set session or security cookies require that you allow those necessary cookies. If you do not allow them, you may still browse parts of the public site, but you cannot use account features that depend on those cookies until you allow them. Details are in privacy_policy.md §7 (Cookie Policy).

In case of conflict:

  1. mandatory law applies first;
  2. school contract/DPA terms (if applicable) may govern specific institutional processing;
  3. these Terms govern general platform use;
  4. Privacy Policy governs personal data processing disclosures.

2) Eligibility and Minors

You may use ArcWealth only if:

  • you can form a legally binding agreement under applicable law; or
  • your parent/legal guardian has authorized your use where required.

ArcWealth is built for educational use, including by minors. We may request age information, guardian contact information, and additional authorization evidence.

If we reasonably believe legally required authorization is missing, invalid, or revoked, we may suspend, restrict, or terminate account access.


3) Account Registration and Security

To use certain features, you must create an account and provide accurate, complete information.

You agree to:

  • keep your credentials confidential;
  • promptly update inaccurate account details;
  • notify ArcWealth immediately of suspected unauthorized access;
  • accept responsibility for activity occurring under your account unless prohibited by law.

ArcWealth may enforce verification and security controls, including email verification, session controls, and optional two-factor authentication.


4) Educational Purpose and No Financial Advice

ArcWealth provides educational content and tools for financial literacy.

The Services are for general educational purposes only and do not constitute:

  • investment advice,
  • legal advice,
  • tax advice,
  • accounting advice,
  • personalized financial advisory services.

You should consult qualified professionals before making personal financial decisions.


5) School, Teacher, and Classroom Use

Where school or teacher workflows are enabled, ArcWealth may allow authorized school/teacher users to access student-related account and progress data necessary for educational delivery and management.

If your account is linked to a teacher/school context:

  • certain profile/progress information may be visible within that authorized context;
  • teacher messages, assignments, and educational notifications may be sent through the platform and email;
  • school-specific terms or institutional agreements may additionally apply.

Schools and educators are responsible for their own compliance obligations when using the Services.


6) Acceptable Use

You agree not to:

  • violate any applicable law or regulation;
  • impersonate another person or misrepresent affiliation;
  • attempt unauthorized access to systems, accounts, or data;
  • interfere with platform security, integrity, or availability;
  • upload or transmit malicious code or harmful content;
  • scrape, harvest, or bulk-extract data without permission;
  • use automated methods to abuse platform limits or workflows;
  • use social/classroom features for harassment, bullying, abuse, or unlawful conduct.

ArcWealth may monitor, investigate, and take action (including account suspension/termination) for suspected violations.


7) User Content and Platform Content

7.1 Your content

You retain rights to content you submit, where applicable.

By submitting content through the Services, you grant ArcWealth a non-exclusive, worldwide, royalty-free license to host, process, display, reproduce, and adapt that content solely as needed to operate, secure, and improve the Services and comply with legal obligations.

You represent that you have the rights needed to submit such content.

7.2 ArcWealth content

ArcWealth and its licensors own all rights in the Services, including software, educational materials, designs, branding, and related intellectual property.

Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from ArcWealth materials.


8) Privacy and Data Protection

ArcWealth processes personal data as described in privacy_policy.md.

By using the Services, you acknowledge that:

  • ArcWealth may process account, learning, security, and communication data needed to deliver the Services;
  • cookies and similar technologies are used as described in privacy_policy.md §7, including a consent-first banner and conditional placement of authentication cookies;
  • transactional emails (for example verification and security messages) are part of account operation;
  • data handling may involve vetted processors/subprocessors under appropriate legal controls (including hosting, database, email, identity providers, and observability providers as listed in the Privacy Policy).

Where required by law, ArcWealth will honor data subject rights and provide mechanisms for rights requests.


9) Communications

By creating an account, you consent to receive service-related communications necessary for operation and security, including account verification, login/security alerts, password reset instructions, and educational workflow notifications relevant to your account context.

Non-essential marketing communications (if introduced) will follow applicable legal consent requirements.


10) Service Availability and Changes

ArcWealth may modify, update, suspend, or discontinue any part of the Services at any time, including features, content, integrations, and security controls.

ArcWealth will use reasonable efforts to provide notice for material changes where practical.

ArcWealth does not guarantee uninterrupted or error-free operation at all times.


11) Fees and Paid Features (If Introduced)

Unless expressly stated otherwise, ArcWealth Services are currently offered without recurring subscription billing.

If paid features are introduced:

  • pricing, billing terms, and refund policies will be presented before purchase;
  • additional commercial terms may apply;
  • mandatory consumer protection rights under applicable law remain unaffected.

12) Account Suspension and Termination

ArcWealth may suspend, restrict, or terminate access (in whole or in part) where reasonably necessary, including for:

  • breaches of these Terms;
  • legal/regulatory requirements;
  • safety, fraud, abuse, or security concerns;
  • missing/invalid parental authorization where required.

You may stop using the Services at any time and may request account deletion subject to legal and operational retention limits described in the Privacy Policy, including when your account is linked to a teacher’s class roster (Privacy Policy §13.2).


13) Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

ArcWealth does not warrant that:

  • the Services will be uninterrupted, secure, or error-free at all times;
  • all defects will be corrected immediately;
  • content will always be complete or up to date for every educational context.

Nothing in these Terms excludes rights that cannot be excluded under mandatory law.


14) Limitation of Liability

To the maximum extent permitted by applicable law:

  • ArcWealth is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the Services;
  • ArcWealth's aggregate liability for all claims arising out of or relating to these Terms or the Services is limited to the greater of:
    • the amount you paid to ArcWealth for the Services in the 12 months before the event giving rise to liability, or
    • EUR 100.

This section does not limit liability that cannot be limited under mandatory law (including certain consumer, child-protection, or data-protection rights).


15) Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless ArcWealth, its directors, officers, employees, and contractors from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • your breach of these Terms;
  • your unlawful misuse of the Services;
  • your violation of third-party rights.

If you are a minor, this obligation applies to your parent/legal guardian to the extent permitted by law.


The Services may integrate with or link to third-party services (for example identity providers, infrastructure providers, or external websites). ArcWealth is not responsible for third-party terms, privacy practices, or content.

Your use of third-party services is governed by their own terms.


17) Governing Law and Dispute Resolution

These Terms are governed by Romanian law, unless mandatory law (including EU consumer protection law) provides otherwise.

Any dispute arising from these Terms or the Services will be submitted to the competent courts in Romania, without prejudice to mandatory jurisdiction rights you may have under applicable law.

You may also have the right to raise certain data protection concerns with the Romanian supervisory authority (ANSPDCP), as described in the Privacy Policy.


18) Changes to These Terms

ArcWealth may update these Terms from time to time for legal, technical, operational, or business reasons.

When material changes are made, ArcWealth may notify users through the Services, email, or other reasonable channels.

Continued use after the effective date of updated Terms constitutes acceptance, unless applicable law requires an additional acceptance mechanism.


19) Severability, Waiver, and Assignment

  • If any provision is found unenforceable, remaining provisions remain in effect.
  • Failure to enforce any provision is not a waiver of future enforcement.
  • You may not assign rights/obligations under these Terms without ArcWealth's prior written consent.
  • ArcWealth may assign these Terms in connection with merger, acquisition, restructuring, or asset transfer, subject to applicable law.

20) Entire Agreement

These Terms, together with the Privacy Policy and (where applicable) Parental Permission Agreement and any valid school-specific contractual documents, constitute the entire agreement between you and ArcWealth regarding use of the Services.
