This Parental Permission Agreement ("Agreement") is entered into between:
- ArcWealth (the "Company"), operated by [INSERT LEGAL ENTITY NAME], with registered address at [INSERT ADDRESS]; and
- the Parent/Legal Guardian identified below, acting on behalf of the minor child identified below.
This Agreement governs a minor's access to ArcWealth's website, app, and related educational services (the "Services").
Important: This Agreement supports legal risk reduction and consent documentation. It does not create absolute legal immunity. Local law, mandatory consumer/child protection rights, and regulator requirements continue to apply.
1) Parent/Guardian and Child Information

The Parent/Legal Guardian confirms they are authorized to grant permission for this child.
2) Purpose and Scope of Consent
By accepting this Agreement, the Parent/Legal Guardian authorizes ArcWealth to:
- create and maintain the child's ArcWealth account;
- process personal data necessary to deliver educational and account-security features;
- provide teacher/school-linked features where applicable;
- send operational and educational service communications related to the child account;
- use cookies and similar technologies in line with ArcWealth’s Privacy Policy (including the Cookie Policy in §7), noting that sign-in and account security cookies are placed only after the user (or someone using the child’s device/browser session) allows necessary cookies in the cookie banner, as described there.
This Agreement applies only to ArcWealth Services and does not cover third-party websites/services that may be linked from ArcWealth.
3) Data ArcWealth May Process for the Child
ArcWealth may process the following categories of child data (as applicable):
3.1 Account and identity data
- account identifier;
- email address;
- first name and last name;
- username;
- date of birth;
- role and account status.
3.2 Profile/education context data
- school, country, city;
- grade level;
- learning goal;
- optional avatar image URL;
- optional gender field.
3.3 Learning and progress data
- lessons/topics started/completed;
- textbook progress;
- XP, level, streak, rank, achievements;
- onboarding/tutorial completion state.
3.4 Teacher/classroom/social feature data
- teacher-student linkage records;
- classroom messages/announcements/assignments;
- teacher nudges and congratulations;
- friend request/friend records (where enabled);
- leaderboard/public profile fields visible to eligible users.
3.5 Security and technical data
- password hash (if password login is used);
- session IDs and timestamps;
- OAuth linkage data (if applicable);
- verification/reset token hashes;
- 2FA-related security data (if enabled);
- Cookie consent preference (
arc_cookie_consent) and, after the user allows necessary cookies on the cookie banner, authentication and OAuth/2FA cookies as described in the Privacy Policy §7; - limited local storage values used for in-app UX (for example learning review state) and optional UI preferences on some pages;
Parents/guardians should understand that the device operator (the child or an adult using the same browser) controls the cookie banner choice for that browser unless ArcWealth provides a separate account-level control.
3.6 Parent/guardian data
- guardian email address for notification and consent-management communication;
- hashed records of one-time parental authorization URL tokens and hashed 6-digit guardian verification codes (stored only long enough to complete or expire the workflow), used together so completing authorization demonstrates access to the guardian inbox.
4) Why ArcWealth Processes Child Data
ArcWealth processes child data to:
- provide and operate educational functionality;
- authenticate users and secure accounts;
- track educational progress and learning outcomes;
- enable teacher/school coordination where relevant;
- send essential transactional/operational emails;
- detect and prevent abuse, fraud, and unauthorized access;
- comply with legal obligations.
ArcWealth does not sell child personal data.
5) Legal Context (EU/Romania)
ArcWealth is offered initially in Romania with EU-hosted data and seeks GDPR-aligned operations.
- Parent/guardian authorization under this Agreement is collected as an additional child-protection safeguard.
- ArcWealth currently requires guardian involvement for users under 18 in the product flow.
- Applicable legal digital-consent thresholds and school-specific legal roles may vary; ArcWealth may request additional confirmation if legally required.
Where required by law or contract, ArcWealth may act as controller and/or processor depending on activity and school arrangements.
6) School and Teacher Access
If the child account is linked to a teacher/school workflow, the Parent/Legal Guardian understands that authorized teacher/school users may access relevant child data, including:
- progress and completion data;
- limited profile/account data necessary for educational management;
- educational notifications/workflow records.
ArcWealth requires school/teacher users to handle child data only for legitimate educational purposes and according to applicable law and contractual controls.
7) Service Providers and Data Sharing
ArcWealth may share child/parent data with vetted service providers only as needed to operate the Services, such as:
- application hosting and infrastructure (e.g. deployment platform and CDN);
- cloud database/storage provider(s);
- transactional email provider(s);
- identity provider(s), where login options are used.
ArcWealth may also disclose data where required by law, regulation, court order, or to protect rights, safety, and platform security.
8) International Transfers
ArcWealth intends to store data in the EU. If access/transfer outside the EEA becomes necessary, ArcWealth will use an appropriate legal transfer mechanism and safeguards required by law.
9) Retention and Deletion
ArcWealth retains child/parent data only as long as needed for educational service delivery, security, legal compliance, and legitimate dispute-handling.
When retention is no longer necessary, ArcWealth will delete or anonymize data, subject to:
- legal retention obligations;
- fraud/security investigation needs;
- backup lifecycle constraints.
The Parent/Legal Guardian may request deletion or restriction, subject to applicable legal and operational limits.
10) Parent/Guardian Rights and Controls
Subject to legal conditions, the Parent/Legal Guardian may request:
- access to child personal data;
- correction of inaccurate data;
- deletion/erasure;
- restriction of processing;
- objection to certain processing;
- portability where applicable;
- withdrawal of consent where processing relies on consent.

ArcWealth may require identity/authority verification before actioning requests.

11) Parent/Guardian Confirmations and Warranties
By accepting this Agreement, the Parent/Legal Guardian confirms that:
- they are the child's parent/legal guardian or otherwise lawfully authorized;
- provided information is accurate and kept up to date;
- they have reviewed ArcWealth's Privacy Policy, including §7 Cookies and Similar Technologies (Cookie Policy);
- they understand ArcWealth cannot guarantee uninterrupted or error-free service at all times;
- they understand no online service can guarantee absolute security despite reasonable safeguards;
- they will promptly notify ArcWealth of unauthorized account use or suspected misuse.
12) Child Account Rules and Safety
The Parent/Legal Guardian agrees to support responsible use, including that the child must not:
- impersonate others;
- misuse teacher/classroom/social features;
- attempt unauthorized access, scraping, or system disruption;
- upload unlawful or harmful content.
ArcWealth may suspend or terminate accounts for safety, integrity, legal compliance, or policy violations.
13) Withdrawal of Permission
The Parent/Legal Guardian may withdraw permission by contacting ArcWealth at [INSERT PRIVACY EMAIL].
After withdrawal request and verification:
- ArcWealth may restrict or close the account;
- applicable data deletion/restriction steps will be applied in line with law and retention obligations;
- some historical records may be retained where legally required.
Withdrawal does not affect processing lawfully carried out before withdrawal.
14) Limitation of Liability and Risk Allocation
To the maximum extent permitted by applicable law:
- ArcWealth provides Services on an "as available" basis;
- ArcWealth is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services;
- ArcWealth's total liability under this Agreement is limited to the amount required by mandatory law and any non-excludable rights.
Nothing in this Agreement excludes liability that cannot legally be excluded (including mandatory child/consumer/data protection rights).
15) Indemnity (Where Lawfully Permitted)
To the extent permitted by applicable law, the Parent/Legal Guardian agrees to indemnify ArcWealth against losses arising from materially false authorization statements or misuse of the child account by the Parent/Guardian in violation of this Agreement.
This clause does not limit the child's non-waivable legal rights.
16) Governing Law and Venue
This Agreement is governed by Romanian law, unless mandatory consumer/data protection law requires otherwise.
Disputes may be submitted to competent courts in Romania, without prejudice to mandatory jurisdiction rights under applicable law.
17) Updates to This Agreement
ArcWealth may update this Agreement where needed for legal, security, or operational reasons.
- Material changes will be notified through appropriate channels (e.g., email/in-app notice).
- Continued use after effective date may require renewed acknowledgment where legally required.
18) Contact Details
Account erasure when the child is in a school class: If the child’s account is linked to a teacher roster in ArcWealth, self-service account deletion in the app may be paused until the teacher or an authorized administrator removes that class assignment. Parents or guardians may also contact the privacy email below to request assisted erasure or to coordinate with the school, as described in the Privacy Policy §13.2.

19) Consent Statement and Signature

- I consent to ArcWealth processing the child and guardian data as described in this Agreement;
- I understand I may withdraw consent (where applicable) and exercise legal rights by contacting ArcWealth.

20) Operational Notes (Internal)
To maximize enforceability and audit readiness, ArcWealth should retain a consent evidence record, including:
- timestamp (UTC), policy/agreement version, and language shown;
- parent identity fields submitted;
- child account identifier;
- consent action type (checkbox + signature + confirmation event);
- source IP and user agent where lawful and proportionate;
- proof of guardian-notification message delivery attempt/status.
